Terms of service
Effective October 17, 2026 · Gallery Composer, made by Suffuse, Asheville, North Carolina
These terms are the agreement between you and us for using Gallery Composer. The short version: your work stays yours, you are responsible for what you publish and sell, and the service comes as is, used at your own risk.
1. Who we are
Gallery Composer (“the service”) is made and operated by Suffuse, a web studio based in Asheville, North Carolina, United States (“Suffuse”, “we”, “us”). It is offered at gallerycomposer.com, at the addresses of the sites people build with it, and through its embed and its AI connector.
2. Agreeing to these terms
By creating an account, or by using the service in any way, you agree to these terms and to our privacy policy. If you use the service for a business or for someone else, you agree on their behalf and confirm you have the authority to. If you do not agree, do not use the service.
You must be at least 18 years old, or the age of majority where you live, to hold an account.
3. Accounts and sites
You are responsible for your login, for keeping your password private, and for everything done through your account, including by people you invite to a site. Tell us straight away at hello@gallerycomposer.com if you think someone else has got in.
One login can open more than one site. Each site has its own owner, its own plan and its own team. The owner of a site decides who can work on it and can hand it to someone else; once a site is handed off, the new owner holds it under these terms and the person who built it has only the access the new owner allows.
The information you give us must be accurate, and you must keep your email address current: it is how we reach you about your account, billing and these terms.
4. Your content
You keep every right you have to the photographs, words, product details and other material you upload or compose (“your content”). We claim no ownership of it.
So that we can run the service, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, format, back up, publish and display your content, only as needed to operate the service, to show it where you publish it, and to support you. The licence ends when your content is deleted from the service, except for copies kept for a limited time in backups, and except where you have shared or published it and others have already received it.
You confirm that you own your content or have every permission needed to upload, publish and sell it, including from anyone pictured in it, and that it does not break any law or anyone else’s rights. You are solely responsible for your content and for what you publish.
Keep your own copies. We back up the service, but we are not a backup for your originals, and you should not rely on us as the only place your work lives.
5. Our software
Gallery Composer itself belongs to Suffuse: the software, the composer and its method of arranging a gallery around its words (the orbital layout, its relationships and targeting), the embed, the AI connector, the designs, templates, text and the Gallery Composer name and mark. These terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the service to make, publish and run your own galleries and sites while your account is in good standing. Nothing else is licensed to you, and every right not expressly given here is reserved.
You may not, and may not help or allow anyone else to:
- copy, modify, translate or make derivative works of the service or any part of it, other than your own content;
- decompile, disassemble, reverse-engineer or otherwise try to work out the source code, algorithms or internal workings of the service, except where the law allows it despite this restriction;
- use the service, its output, or anything learned from it to build, train or improve a product or service that competes with it, or to copy its features, layouts, behaviour or look;
- scrape, crawl, harvest or extract data or code from the service by automated means, other than through the embed and the AI connector as we provide them;
- rent, resell, sublicense, or offer the service to others as a service of your own, except by building sites for clients as these terms allow;
- remove, hide or alter any copyright, trademark or other notice on the service.
The code that runs your galleries in a visitor’s browser is part of the service and is covered by these restrictions, even though a browser can read it. If you send us ideas or suggestions, we may use them freely and owe you nothing for them.
6. Acceptable use
You may not use the service to:
- publish or sell anything unlawful, infringing, defamatory, obscene, harassing, or deceptive;
- publish content that sexualises minors, promotes violence, or exposes another person’s private information;
- sell goods or services that are illegal, counterfeit, or that Stripe’s rules forbid;
- send spam or unsolicited messages, or run phishing, fraud, or impersonation;
- upload malware, or probe, scan, overload, or attack the service or anyone using it;
- get into accounts, sites, or data that are not yours, or get around a limit, a password, or a plan;
- scrape the service, or resell or re-host it, except as its features allow;
- use the service in a way that harms us, our providers, or other customers.
Content we do not host
Gallery Composer is for showing and selling work. Some kinds of site are not allowed on it at all, whatever their legality:
- Explicit content. Sexually explicit or pornographic material of any kind, content made for sexual gratification, adult services, and graphic or gratuitous violence or gore. Non-sexual nudity in fine art (figure painting, life drawing, sculpture, and photography in that tradition) is allowed, provided it is not sexually explicit or presented for sexual gratification.
- Hate. Content that attacks, demeans, or promotes hatred or violence against people for their race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or similar characteristics; and the symbols, materials, or fundraising of groups organised around such hatred.
- Political sites. Sites, galleries, or stores for political campaigns, candidates, parties, political action committees, ballot measures, or elected or government office-holders acting as such; political advocacy, lobbying, or organising; and political fundraising or the sale of political merchandise. This applies to every party, cause, and point of view, without exception.
Whether a site falls into one of these categories is our decision, made at our sole discretion. Work that only touches on these subjects in passing is not automatically barred, but a site whose purpose is any of the above is.
We may remove content, unpublish a site, or close an account that we believe breaks this section, with or without notice. Where a plan was paid for, a site removed under this section is not refunded.
7. Selling
If you sell through the service, the sale is between you and your buyer. You are the merchant of record. Payments run through your own Stripe account, under Stripe’s terms; we do not hold, receive, or pay out your money, and we are not a party to any sale.
You alone are responsible for your products and prices; for describing them accurately; for stock, fulfilment, shipping and delivery; for returns, refunds, chargebacks and disputes; for customer service; for your own store policies; and for collecting and paying any sales tax, VAT or other tax that applies to you. Your buyers’ questions about an order go to you.
We make no promise that you will make any sales, or any amount of them.
8. Third-party services
The service relies on, and connects to, services run by others, including Stripe (payments and billing), Cloudflare (storage and delivery), Amazon Web Services (hosting and email), domain registrars, Google Fonts, and AI assistants you choose to connect. Your use of those services is governed by their own terms and privacy policies. We are not responsible for them, for their availability, or for what they do with information you give them.
Sites and galleries may link to other websites. We do not control and are not responsible for those websites.
9. AI connectors
You can connect an AI assistant to your account. When you do, you authorise that assistant to read the information it is given access to and to make the changes the connector allows on your behalf. You are responsible for what you ask it to do and for the changes it makes. AI output can be wrong; check it. You can revoke a connection at any time from Account.
10. Plans, billing and refunds
Some features need a paid plan. Plans, prices and what each includes are shown on the plan page and may change; we will give you at least 30 days’ notice by email before a price change applies to a plan you already pay for.
Our share of your sales. When a buyer pays you through the service, we keep a share of each piece’s price, set by your plan: 5% on Free, 2% on Core, and nothing on Sell, never more than US$25 on any one piece. It is not charged on shipping or tax. Stripe deducts it from the payment at the time of the sale, alongside Stripe’s own processing fee, which is Stripe’s and not ours. If you refund a sale in full from the service, we return our share of it. We may change these rates with at least 30 days’ notice by email; a change never applies to a sale already made.
Paid plans are billed in advance, monthly or yearly, through Stripe, and renew automatically at the end of each period until you cancel. You can cancel at any time from the plan page; the plan stays active until the end of the period you have paid for and then does not renew.
Payments are non-refundable, including for partly used periods, unused features, or downgrades, except where the law requires otherwise or we decide, at our discretion, to make an exception. Prices do not include taxes unless stated; you are responsible for any that apply.
If a payment fails, we may retry it, and may limit or pause the paid features of a site until it is paid. A free plan, or a site opened for a client before it is handed off, may have limits, and we may change what free use includes.
11. Domains
If you connect a domain you own, you remain responsible for it and for its registration with your registrar. If you buy a domain through the service, it is registered in your name through our registrar partner, is subject to the registrar’s and the registry’s rules, and renews yearly while it is paid. Domain fees are non-refundable once the domain is registered. Letting a plan or a domain renewal lapse may mean the domain expires and becomes available to others; keeping it renewed is your responsibility.
12. The service
We work to keep the service running and your work safe, but we do not promise that it will be available at any particular time, without interruption, or without errors. We may carry out maintenance, and we may add, change, or remove features, or end the service altogether. If we end the service, or a feature that holds your content, we will try to give you reasonable notice and a way to download your content first.
We make no claims about how the service, your site, or your galleries will perform: not about page speed, search ranking, traffic, visitors, conversions, sales, or any other result. Anything we say about results, on our site or elsewhere, is a description, not a guarantee.
13. No warranties
You use the service at your own risk. The service, and everything on it or made with it, is provided “as is” and “as available”, without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, or that it will be uninterrupted, timely, error-free, or that any defect will be corrected or any content preserved. No advice or information from us creates any warranty not stated here.
14. Limitation of liability
To the fullest extent the law allows, Suffuse, its owners, staff, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, sales, business, customers, goodwill, or data, or for the cost of substitute services, arising out of or related to the service or these terms, however caused and whether or not we were told such loss was possible.
Our total liability for all claims arising out of or related to the service or these terms is limited to the greater of the amount you paid us for the service in the three months before the event giving rise to the claim, or fifty U.S. dollars (US$50).
Some places do not allow certain exclusions or limits; where that is so, these apply to the fullest extent allowed.
15. Indemnity
You will defend, indemnify, and hold harmless Suffuse and its owners, staff, and contractors from any claims, losses, damages, liabilities, and costs (including reasonable legal fees) arising out of your content, your sales and dealings with your buyers, your use of the service, your breach of these terms, or your breach of any law or anyone’s rights.
16. Copyright complaints
We respect copyright and expect our customers to. If you believe something published with the service infringes your copyright, email hello@gallerycomposer.com with: your contact details; a description of the work; the address of the material you believe infringes; a statement that you believe in good faith the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them; and your physical or electronic signature. We will remove or disable material where appropriate and may close the accounts of repeat infringers. If your content was removed and you believe that was a mistake, you may send us a counter-notice with the same details.
17. Suspension and closing
You can close a site, or your whole account, at any time from within the service. We may suspend or close an account or a site, or remove content, if you break these terms, if we must by law, if your use puts the service, other customers, or us at risk, or if a paid plan goes unpaid. Where reasonable we will tell you first.
When an account or site is closed, its galleries are unpublished and its content is deleted, apart from limited copies kept in backups for a short time and records we must keep by law. Sections of these terms that by their nature should last beyond closing, including content licences already used, payment owed, the warranty disclaimer, the limitation of liability, indemnity, and governing law, continue to apply.
18. Governing law and disputes
These terms are governed by the laws of the State of North Carolina and the United States, without regard to conflict-of-law rules. Before bringing any claim, you agree to contact us at hello@gallerycomposer.com and try in good faith to resolve it informally for at least 30 days. Any claim that is not resolved must be brought only in the state or federal courts located in Buncombe County, North Carolina, and both of us consent to their jurisdiction. Any claim must be brought within one year after it arose, or it is permanently barred. To the extent the law allows, claims may be brought only individually, not as part of a class or representative action.
19. Changes to these terms
We may update these terms. If a change is material, we will tell account holders by email or in the service at least 14 days before it takes effect. Continuing to use the service after a change takes effect means you accept it; if you do not, you may close your account.
20. General
These terms and the privacy policy are the whole agreement between you and us about the service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a part of these terms is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a merger, sale, or reorganisation. We are not responsible for delays or failures caused by events beyond our reasonable control. Notices to you may be sent to the email on your account; notices to us go to the address below. Headings are for convenience only.
